Man free on bail after Jan. shooting at taco shop

Phillip Troy Relos, 23, of San Diego, is awaiting a March 20 preliminary hearing after being charged with assault with a deadly weapon in the Jan. 21 shooting of a man in the 4500 block of Dawes Street in Pacific Beach. Relos has pleaded not guilty to shooting David Fitzpatrick, 24, in the abdomen with a pistol. Fitzpatrick was taken to a hospital and is recovering.
The incident occurred around 2 a.m. when the victim walked up to the driver of a parked Saab. The two men got in an argument before Relos allegedly shot Fitzpatrick and then fled in his car. A San Diego Police officer stopped the Relos near the intersection of Lusk and Mira Mesa Boulevard and he was arrested.
Relos appeared Feb. 13 before San Diego Superior Court Judge Jeff Fraser, and he set the March 20 hearing. Relos has posted $50,000 bond and remains free.
